On request of several Nmart members who were unable to understand this order, I am here by giving you my personal view & explanation of this court order dated 29/10/2012.
Firstly this is the only writ petition WP/3751/2012 of Mumbai High Court which is related to business part of the company. Other writ petitions in Mumbai High Court are related to bail and F.I.R. quashing of Gopal Mohan Shekhawat, Pratibha Shekhawat and Director’s of the company. I had been giving relevant and authentic information’s related to Nmart and posted it in face book and website only after getting the documentary proof.
There are three important facts which you all Associates should know regarding this order and entire case going on Mumbai and Andhra Pradesh High Courts.
1. I humbly requested all the members before the hearing in Mumbai High court on date 29/10/2012 to wait patiently and not to believe any body unless you see authentic written court orders. Also I cautioned all of you to be aware from several so called leaders who will come out like seasonal frog, giving misleading statement and hiding their black face and switching off their mobile in hard time. From 29/10/2012 to 02/11/2012 these frog came out and started doing tarr tarr by giving misleading statement such as “bank account opened, website started, we have won the case” etc. Hearing these entire rumor, on date 02/11/2012, I uploaded on website and face book an authentic true copy of order passed on date 29/10/2012. All of you can see no such orders passed on that day.
2. Members please do not believe and become confused by the comments of people giving without evidence. Know the facts. This case has been withdrawn by the Company on 05/11/2012 because objection has been raised by the advocate of opposite part No. 2 regarding the territorial jurisdiction of this writ petition. It means that this case was to be heard in Andhra Pradesh High Court not in Mumbai High Court. It is mentioned in the third point of order dt 29/10/2012. The next date to list this case was on 05/12/2012 as mentioned in the second point of this order. If our company lawyer would have waited till 05/12/2012 and then the justice would have passed the order to go to Andhra Pradesh High Court, then one month time would have been wasted. Therefore our company’s lawyer decided to withdraw this case and file immediately in Andhra Pradesh court.
3. Order passed on date 09/10/2012 in writ petition WP/27101/2012 of Andhra Pradesh court states that our company has been granted permission to file a fresh petition. In this petition a show cause notice has been issued to the opposite party on date 03/10/2012. Considering both the facts of Mumbai High Court order dated 29/10/2012 and Andhra Pradesh High Court order dated 09/10/2012 our company has decided to file a fresh writ petition in Andhra Pradesh High Court. This writ petition will contain all business issues of our Company such as bank account opening, website opening, running of malls etc. According to Advocate Niranjan Reddy this writ petition is ready to be filed within a couple of days. Hopefully within two days. Thereafter associates be ready and hope to get a favorable good judgment in our favor.
